WPCRL No. 1135 of 2011

withCLMA No. 13871 of 2011

Hon'ble Prafulla C. Pant, J.

Mr. Sanjeev Singh, Advocate, present for the petitioners.

Mr. S.S. Adhikari, A.G.A., present for the State.Heard.

By means of this writ petition moved under Article 226 of Constitution of India, the petitioners have sought quashing of the FIR dated 06.08.2011, registered as crime no. 264 of 2011, relating to offences punishable under section 147, 148, 323, 332, 427 IPC, at Police Station Manglore, District Hardwar.

Learned counsel for the petitioners submitted that the FIR is delayed one. It is further submitted that there is no specific role assigned to the accused. It is also pleaded that it is not clear as to who suffered injury.

However, on going through the contents of the FIR, it appears that public servants while discharging their duties were manhandled, beaten, and public property was damaged by certain persons.

Having considered submissions of learned counsel for the parties, and after going through the papers on record, in the facts and circumstances of the case, this court is not inclined to interfere with the investigation of the case.

Therefore, the writ petition is dismissed summarily with the observation that if the petitioners Umesh, Shiv Sharma, Mintu, Dhiraj, Lillu, Rajveer, and Devendra surrender before the court concerned their bail application shall be heard and disposed of without unreasonable delay. (Stay application no. 13871 of 2011, stands disposed of).
