The petitioner has challenged Clauses 2(h), 3 and 5
of the Gujarat Rice Procurement (Levy) Order, 1983. When this petition is called out, it is pointed out by the learned Assistant Government Pleader that the Gujarat this petition is called out, it is pointed out by the learned Assistant Government Pleader that the Gujarat Rice Procurement (Levy) Order, 1983 has been repealed by the Gujarat Rice Procurement (Levy) Order, 1984. In view of the repeal of 1983 Order, the challenge against its validity does not survive. This petition is therefore rejected as having become infructuous. Rule is discharged with no order as to costs.
