HIGH COURT OF UTTARANCHAL AT NAINITAL

Writ Petition No. 1103 of 2001 (MS) (Old No. 44211/1999)

Km. Meenakshi Agrawal & others

……… Petitioners

Versus

Additional Commissioner Conslolidation Lucknow & others

……. Respondents

Dated: 25.8.2004

Hon. Rajesh Tandon J.

By the present writ petition the petitioner has prayed for a writ of certiorari for quashing the order dated 1.10.1999 passed by the Additional Commissioner Consolidation, Lucknow, thereby rejecting the Transfer Application No. 576 of 1999, Km. Meenakshi Agrawal and others vs. Manoj Narain and others.

Briefly stated the petitioner moved a transfer application before the respondent no.1 for transfer of Case No. 881, Manoj Narain vs. Km. Meenakshi Agrwal and others under section 9(1)(a) of U.P. Consolidation of Holdings Act, in respect of plots of village Pamdari, Tehsil Kichcha, District Udham Singh Nagar, pending before the Consolidation Officer, Kichchha, District Udham Singh Nagar to any other competent court in adjoining district.

The writ petition has been filed in the year 1999 before the Allahabad High Court but no stay order has been granted. By efflux of time the writ petition has become infructuous.

The writ petition is, therefore, dismissed as infructious. No order as to costs.
