C482 No.1469 of 2013Hon’ble V.K. Bist, J.

Mr. Pramod Bailwal, Advocate for the applicant.

Mr. M.A. Khan, A.G.A. with Ms. Sangeeta Miyan, Brief Holder for the State. Heard learned counsel for the parties.

This criminal misc. application has been filed by the applicant for expediting the Criminal Complaint Case No.756 of 2010 “Ved Kishore Belwal Vs. Anil Joshi” under Section 138 of Negotiable Instrument Act pending before the learned Judicial Magistrate, Kotdwar.

Learned counsel for the applicant, by referring Section 143 (3) of Negotiable Instrument Act, submitted that the proceedings of the case under Section 138 of Negotiable Instrument Act should be concluded within a period of six months. He submitted that in the case in hand, though about three years have passed but the proceedings of the said case has not been concluded so far. He prayed that direction may be issued to Magistrate concerned to decide the said case at the earliest.

I have considered the submission advanced by the learned counsel for the applicant.

Considering the submission advanced by the learned counsel for the applicant and also considering the fact that the said case is pending before the Magistrate since 2010, I dispose of this criminal misc. application with a direction to the concerned Magistrate to decide the Criminal Complaint Case No.756 of 2010 “Ved Kishore Belwal Vs. Anil Joshi” under Section 138 of Negotiable Instrument Act very very expeditiously.
