Criminal Misc. Transfer Application No.21 of 2002
Hon. A. A. Desai, C. J.
Heard Sri S.K.Mandal, learned counsel for the applicant and learned A.G.A.
learned counsel for the applicant
This is an application purporting to be under secrtion 407,Cr.P.C. For transfer of Crl.Case No.213 of 2002 pending b efore A.C.J.M. Kashipur to any other Court.
The only ground which the learned counsel for the applicant has suggested is that there is tempering of order. Learned counsel, however, could not spell out what exactually was tempered. His 'Vakalatnama' was missing. The Presiding Officer is taking appropriate action and has already issued notice to the Peshkar. Therefore, no ground is made out for transfer of case u/s407,Cr.P.C.
The application is rejected.
