IN THE HIGH COURT OF UTTARANCHAL AT NAINITAL

Civil Writ Petition No. 1038 (M/B) 2003

Naresh Kumar Babbar, S/o Sri Ved Prakash, R/o D-1/D-2/28, Adarsh Colony, Rudrapur, Distt. U.S. Nagar …………….. Petitioner

Versus

Uttar Pradesh State Warehousing Corporation and another ……………... Respondents Mr. Rakesh Thapliyal, Advocate for the petitioner. Mr. Tanveer Alam Khan, Advocate for the respondents.

Coram: Hon. S. H. Kapadia, C. J. Hon. M.M. Ghildiyal, J.Dated: 14.11.2003:

PC:

By this writ petition, petitioner has challenged Tender Notice dated 08.10.2003 issued by the Uttar Pradesh State Warehousing Corporation, Dehradun in ‘Dainik Pradhan Times’, Rishikesh inviting Tenders. It is the case of the petitioner that ‘Dainik Pradhan Times’, Rishikesh is not widely circulated Newspaper. Prima facie, we are satisfied that ‘Dainik Pradhan Times’, Rishikesh is not circulated widely in the State of Uttaranchal. However Tender has been opened. Hence, we do not wish to interfere.

In future U. P. State Warehousing Corporation, Dehradun will publish such Tender Notice in ‘Amar Ujala’ / ‘Dainik Jagarn’. These two papers are widely circulated in the State of Uttaranchal. Accordingly, writ petition is disposed of.
