…………………..Applicant(s) Versus State of Uttaranchal. ……………….. Opposite Party _________________________________________________________________________ Arising out of- Case crime no. 21of 2002, Under section 21/22 N.D.P.S. Act, P.S.G.R.P. By the Court
Hon’ble Irshad Hussain, J.
Heard the learned counsel for the applicant and the learned Assistantl Government Advocate.
Sufficient time was given to report whether the applicant-accused has criminal history or not. Nothing has been shown. The report of the expert is also not available. Considering the description of the alleged contraband and the approximate weight of the same to be taken, it appears to be a case of small quantity and considering the facts, the quantity of the contraband and no allegation of previous conviction, there are reasonable grounds to accept at this state the argument that the applicant has not committed the offence and there is no likelihood of his engaging himself in similar activity, if released on bail.
Let the applicant Sompal S/o That Singh, r/o village Nanauta, P.S. Nanauta, district Saharanpur, be released on bail incase crime no. 21of 2002, under sections 21/22 N.D.P.S. Act, P.S.G.R.P. Haridwar, district Haridwar on his filing a personal bond and adequate sureties to the satisfaction of Special Judge Hardwar.
Saharanpur, be released on bail incase crime no. 21of 2002, under sections 21/22
