Arising out of Case Crime No.: 01 of 2002

By the Court

Hon'ble A. A. Desai, C. J.

Heard Sri Birendra Singh Adhikari, learned counsel for the applicant and learned Government Advocate.

The applicant is facing prosecution for the offence punishable under Sections 307, 504, 506,I.P.C. The incident involving the prosecution is outcome of triffle dispute. The applicant is aged about 19 years. The nature of injury at this stage, prima facie, dose not indicate that there was any attempt to kill. In view of this, I direct that the applicant be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the C.J.M. Pithoragarh.

The above observations are tentative and shall not be taken into account during the trial.
