WPSS No.1391 of 2007

Hon’ble Kalyan Jyoti Sengupta, J.

Mr. Vijay Bhatt, Advocate present for the petitioner.

Mr. Subhash Upadhyay, Standing Counsel present for the State of Uttarakhand.

It appears inspite of communication having being made by the writ petitioner to the respondent i.e. his application for sanctioning leave for the period during which the petitioner had spent to join to promotional post, no order of rejection is served. Only communication thereof is sent to the petitioner.

Under this circumstance, I dispose of the writ petition directing respondents authority to forthwith supply copy of the rejection order to the petitioner to enable him to take steps in accordance with law. I am of the view that respondents should have supplied copy of the rejection order to the petitioner. The copy of the order shall be supplied in terms of this order within seven days from the date of communication of this order, failing which, the effect of the said order will stand extinguished, and in that event, it shall be presumed that representation of the petitioner is deemed to have been allowed and leave has been sanctioned. If the impugned order of rejection is forwarded to the petitioner, it would be open for the petitioner to take steps in accordance with law.
