BA1 No.2019 of 2017

Hon’ble V.K. Bist, J.

Mr. Shashi Kant Shandilya, Advocate for the applicant.

Mr. Lalit Miglani, Brief Holder for the

State of Uttarakhand.

Heard learned counsel for the parties. The applicant has moved this bail application seeking regular bail in connection with Case Crime No.426 of 2017 under Sections 147, 323, 332, 353, 504 of IPC, Police Station Kotwali Roorkee, District Haridwar.

The allegation against the applicant is that he came to the police station with other person and tried to take away one Smt. Rajbala from the police custody.

Learned counsel for the applicant submitted that the applicant has falsely been implicated in the instant case as he was the driver of the vehicle in which the supporters of Smt. Rajbala came. He further submitted that the applicant has no criminal history and he is in jail since 12.11.2017.

Having considered the submission of learned counsel for the parties and without expressing any opinion as to final merits of the case, this Court is of the view that applicant deserves bail.

Accordingly, the bail application is allowed. Let the applicant Ankur be released on bail on his executing personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Magistrate concerned.
