Petitioner who is the 3[rd] accused in Crime No.526/06 ofHosdurg Police Station for an offence punishable under section 379read with section 34 IPC in respect of a lorry, seeks anticipatory bail. The offence was committed on 30.11.2006.

2. Learned Public Prosecutor opposed the applicationsubmitting, inter alia, that accused 1 and 2 who were the co-accusedin the offence were arrested on 9.12.2006 and 15.12.2006respectively and the petitioner is also having the same degree ofcomplicity. There is no reason why the petitioner should notsurrender before the Magistrate concerned and seek regular bail.Accordingly, if the petitioner surrenders before the Magistrateconcerned and files an application for regular bail, within two weeksfrom today, the same shall be considered and disposed of, preferablyon the same date on which it is filed.

With this direction, this petition is disposed of.
