ORAL JUDGEMENT
1. The matter was called out for hearing in the first round in first sitting then in the second round and third round in second sitting but none put appearance for the petitioner. Perused the special civil application and heard the learned counsel for the respondent.
2. The petitioner, a Deputy Mamlatdar of the Revenue Department of the Government of Gujarat, filed this special civil application before this Court and challenge has been made to the order dated 2-12-1985 to the extent it relates to the petitioner under which he was ordered to be reverted from the post of Deputy Mamlatdar to that of Clerk. This order has been stayed by this Court and for all these years it was not given effect to. Thereafter much water has flown and fresh seniority list of feeder cadre has been prepared in pursuance of the direction of this Court and what is the latest position of the petitioner in the matter of seniority and promotion has not been brought on record of this special civil application by either side.
3. The interest of justice will be met in case this Special Civil Application is disposed of with the direction that in case still now the respondent considers that the petitioner should be reverted from the post of Deputy Mamlatdar then order may be passed only after giving a notice and an opportunity of hearing to the petitioner. It is further made clear that any order passed against the petitioner should be a reasoned order and copy of the same may be sent to the petitioner by registered post. The special civil application and rule stand disposed of in the aforesaid terms with no order as to costs.
