WPCRL No.107/09 Hon’ble Dharam Veer, J.

(Delay Condn. Appln. No.11385/09)

None is present for the petitioners.

Sri M.A. Khan, learned brief holder for the State. Perused the application supported by affidavit. Delay in filing the counter affidavitis condoned. Delay condonation application is accordingly allowed.

Learned brief holder makes a statement that after completion of investigation, charge sheet has been filed against the petitioners-Mohd. Islam, Sarfaraz and Mohd. Haneef. Averment to this effect has also been made in paragraph no.2 of the counter affidavit filed by the I.O.

In view of the above development, the writ petition has now become infructuous. The writ petition is, therefore, dismissed as infructuous with the observation that interim order dated 02.03.2009 passed by this Court shall continue till the charge sheet is received by the court concerned.
