CLMA 11049/2010

In WPCRL 1111/2010Hon’ble Prafulla C. Pant, J.

Shri S.K. Mandal, Advocate, present for the petitioners.

Shri S.S. Adhikari, AGA, present for the State.

Heard.

By means of this writ petition, moved under Article 226 of the Constitution of India, the petitioners have sought quashing of the First Information Report No. 500/2010, registered at police station Kotwali City, District Dehradun, relating to offences punishable under Section 452, 506, 307 IPC.

Perusal of the FIR shows that the petitioners are named in it. The injured, in the incident, appears to have suffered five lacerated wounds.

Having considered the submissions of learned Counsel for the parties, this Court is not inclined to interfere with the investigation of the case.

The writ petition is dismissed summarily with the observation that if the petitioners surrender before the court concerned, their bail applications shall be heard and disposed of without unreasonable delay.

(Stay application no. 11049 of 2010 stands disposed of.)
