I.P.C and subsequently altered into 120(B), 147, 148, 294(b), 302 and 341 of I.P.C. The petitioners were arrested and remanded to custody on 30.10.2023.

2. The case of the prosecution is that owing to previous enmity, the petitioners along with other accused had committed the act of murder against the deceased. Hence, the case.

3. Learned counsel for petitioners submitted that the petitioners are innocent and they have been falsely roped in this case. He further submitted that A4 had been granted bail by this Court in Crl.O.P.No.28533 of 2023 by an order dated 20.12.2023. Hence, he prays for grant of bail to the petitioners.

4. Learned Additional Public Prosecutor submitted that due to previous enmity, the petitioners along with other accused had murdered the deceased. Hence, he vehemently opposed to grant bail to the petitioners.

5. Considering that no specific overt act has been attributed against the petitioners and based on the confession only they have been added as accused and considering the number of days of incarceration by the petitioners and material part of investigation has been completed and A4 had been granted bail, I am inclined to grant bail to the petitioners, subject to certain conditions.
