WPMS No. 2750 of 2011

Hon’ble Tarun Agarwala, J.

Mr. Tapan Singh, Advocate on behalf of Mr. Lok Pal Singh, Advocate for petitioner.

On an application moved by the local counsel, the District Judge after ascertaining the matter, released the case from the Presiding Officer and transferred it to another court. The petitioner, being aggrieved by the said order, has filed a recall application which was rejected and, consequently, the writ petition.

Upon hearing the learned counsel for the petitioner, the Court finds that the District Judge was justified in transferring the suit to another court since it found that the local counsel at some moment of time had taught the Presiding Officer in school/college. In the opinion of the court, the order of the District Judge was perfectly justified which requires no interference. The writ petition is dismissed.

Certified copy of the order shall be sent by the Registry to the court below within ten days from today for necessary information and action.

Dated 30.12.2011 Shiv

(Tarun Agarwala, J.)
