IN THE HIGH COURT OF UTTARANCHAL AT NAINITAL.

Writ Petition No. 1655 of 2003 (S/S) Smt. Saroj Arya

….Petitioner.

Vs.

District Magistrate Almora and others ….Respondents.

Hon’ble Irshad Hussain, J.

Heard Sri Pramod Bailwal leaned counsel for the petitioner and Sri J.P.Joshi learned Standing counsel for the respondent. 2- This is a petition seeking quashing of the impugned order of transfer dated 18-12-2003 (Annexure-6). The learned counsel for the petitioner submitted that the petitioner is pregnant and it will be difficult for her to take up the assignment at the transferred place. Perusal of the impugned order indicate that the petitioner was temporarily attached to the office at Almora on her personal request and hardship as mentioned in the order dated 9-10-2002 and that attachment was for only one year. More than a year has now passed and the temporary attachment can very well be changed and the petitioner may be reverted back to her original place of posting.

3- Considering this there is no merit in this petition and the same is dismissed.

Dated: 24.12.2003

(Irshad Hussain, J.)
