Madras High Court

WRIT PETITION 19499 of 1999 on 25 August 1998

WP No.19499 of 1999

The Hon`ble The CHIEF JUSTICE

and

The Hon`ble Mr Justice T. S. SIVAGNANAM

Tmt.Meera Srinivasan, (Died)

W/o.Late Srinivasan, 130, 8th Main Road, Annanagar, Madras-600040. and 6 others.

Vs

THE AUTHORISED OFFICER,

VILLUPURAM and 5 others.

The effect of the leave granted today to urge the additional grounds is that the impugned order dated 25.08.1998 cannot be sustained on the ground that it has been passed by the Administrative Member of the Special Tribunal (Chairman since retired), which is without jurisdiction, in view of the judgment of the Division Bench of this Court in T.Krishnaraj vs. Land Commissioner (Land Reforms), Chennai and Others, reported in 2010 (5) MLJ 68. The further development is that it is not possible to remit the matter back to the Special Tribunal, in view of the dismantling of the Special Tribunal and all such matters were laid before the learned Single Judge to be decided on merits.

2. In the factual position, the original order was passed by the Authorised Officer (Land Reforms), dated 25.09.1977, which was in turn confirmed by the Land Tribunal vide order dated 02.02.1983. The :2:

correctness of these two orders would have to be assailed by the petitioner now before the learned Single Judge.

3. It is, thus, agreed that the present Writ Petition be placed before the learned Single Judge, in view of the subsequent developments.

4. Since the matter is old, the same be placed on 08.07.2015 before M.Duraiswamy,J.
