HIGH COURT OF UTTARANCHAL AT NAINITAL

COURT NO.2

Writ Petition No. 1269 (M/B) 2003

Vijay Pal Singh S/o Sri Baroo Singh, R/o village Bindoo, Post Bhalsawaj Ganj, Distt. Haridwar.

Vs.

State of Uttaranchal through Secretary Education, And three others.

…..Petitioner

…Respondent

Hon’ble P.C. Verma, A.C.J.,Hon’ble Rajesh Tandon, J.

This writ petition has been field by the petitioner seeking a writ of mandamus commanding the respondents No. 1 to 3 to exercise powers U/s 16(D) of Intermediate Education Act and to supersede Management Committee and to appoint Authorised Controller.

Briefly stated that respondent No.4 was elected manager of Management Committee of national Inter College Bhalsawaj and is indulging in using the properties of the Institution for his own use. The petitioner and several other persons have made several representations before the respondents and other authorities of Education Department.

Heard Sri Arving Vashishth, learned counsel for the petitioner and learned Chief Standing Counsel.

Learned counsel for the petitioner has confined his argument to the extent that the respondents may be directed to decide the representation dated 30.07.203 (annexure-1 to the writ petition) field by the petitioner alongwith the other residents of Bhalsawaj Ganj, Haridwar.

The prayer is innocuous and deserves to be accepted.

Accordingly, the respondents are directed to decide the representation already filed by the petitioner alongwith the other residents of Bhalsawaj Ganj, Haridwar on 30.07.2003, expeditiously.

With the aforesaid observations, the writ petition is disposed of.

(Rajesh Tandon, J.)

(P.C. Verma, A.C.J.)
