Heard learned counsel for the applicant-accused and the Assistant Government Advocate.
Case is triable by the Magistrate. Applicant-accused was not arrested on the spot. Considering this, in my opinion it is a fit case for bail.
Let the applicant Bhagwan Singh son of late Bachan Singh, r/o village Rampur, P.S. Rudra Prayag, District Rudra Prayag be released on bail in case crime no.455 of 2002, under sections 379, 411 of I.P.C. , 26/52 of Forest Act, 19/28 (2) U.P. Transport of Timber Act, under Forest Rules, Police Station Rudraprayag, District Rudraprayag on his filing a personal bond and adequate sureties to the satisfaction of C.J.M., Rurda Prayag.
