Writ Petition No. 943 (SB) of 2001

Hon. A.A. Desai, C. J. Hon. P.C. Verma, J.

Heard Sri V.K. Bist, learned counsel for the petitioner.

The petitioner entered into service on 25.02.1969. At that time his date of birth was recorded 26.11.1941. In the year 1984, the petitioner raised dispute about his date of birth. He thereafter approached to the Central Administrative Tribunal. The tribunal rejected the claim by its order dated 1.11.2001 observing that the entry was duly certified by the employee and as such interference is not warranted. In this petition, Mr. Bisht, learned counsel for the petitioner raised a ground that the date of birth of his elder brother is 8.4.1942. As such the date of birth as recorded is erroneous. We can not enter into this disputed question of fact. Even otherwise, the objection raised by the petitioner about date of is highly belated. The petition is without any merit. The same is dismissed accordingly.
