Criminal Revision No. 48 of 2001 (Old No. 1625/1987) Hon’ble Irshad Hussain, J.

None appear for the revisionist-complainant.

A.G.A.is present.

Perused the judgment with the help of A.G.A.

The learned Magistrate has carefully appraised the evidence of the complainant, P.W.1 and his mother, P.W.3 and came to the conclusion that their evidence is not conclusive about the assault and theft of money from them. According to the revision of the F.I.R., there were six accused who were armed with knives and they assaulted the victim. But the medical evidence also did not support the claim of the complainant, Kesar Singh.

The judgment of acquittal is based on fair and proper appraisal of the material on record and this revision has no merit and is dismissed.

Consign.

(Irshad Hussain, J.)
