Heard the learned counsel for the applicant-accused and the learned Additional Government Advocate.
From the version of the F.I.R it was evident that the murder of the victim Smt.
Shanta Devi was committed. There was no direct evidence to the occurrence. After investigation chargesheet is said to have submitted under section 306 of the I.P.C.
The occurrence is said to have taken place on 10.08.2002. Inquest was held on 12.08.2002 when the father and brother of the deceased were present. However, the F.I.R. was lodged on 20.08.2002. Considering totality of circumstances of the case in my view it is a fit case for bail.
Let the applicant Sohan Lal son of Sri Sant Lal, resident of Dharamgath, Patti Makhlogi, District Tehri Garhwal be released on bail in case crime no.1 of 2002, under sections 306 of I.P.C., Patwari Circle Nakot, District Tehri Garhwalon his filing a personal bond and adequate sureties to the satisfaction of C.J.M., Tehri Garhwal.
Makhlogi, District Tehri Garhwal be released on bail in case crime no.1 of 2002, 21.11.02/B.
