!For Appellants : Mr.V.R.Shanmuganathan,Special Government Pleader ^For Repondents : Mr.Joseph Thatheus Jerome :JUDGMENT(Judgment of the Court was made by S.MANIKUMAR, J)

Instant writ appeal has been filed against the order, made inW.P.(MD)No.3562 of 2010, dated 24.01.2014, by which, the writ court, while allowing the writ petition, directed the appellants to regularise theappointment of the 1st respondent as a Secondary Grade Teacher, from15.07.2002, with all attendant and monetary benefits, with the specifiedperiod.

2. Facts leading to the writ petition are that the 1st respondent was appointed as a Secondary Grade Teacher in 2nd respondent~School on 15.07.2002in the vacancy arose on 04.06.2002, due to transfer of another teacher. Whenthe School authorities approached the Educational Authorities, for approvinghis appointment duly made in accordance with the procedure laid down underRules in the sanctioned post, the District Educational Officer, V.O.C.Government Higher Secondary School, Kovilpatti, Thoothukudi District, 1stappellant herein, passed an order, dated 21.8.2002, refusing to approve herappointment. On the other hand, the first appellant has granted approval ofhis appointment, with effect from 01.06.2003, as Secondary Grade Teacher, onconsolidated pay of Rs.3,000/~ per month and thereafter, his appointment wasapproved as a Secondary Grade Teacher, with effect from 1.6.2006, in the timescale of pay. Aggrieved by the same, the petitioner has preferredW.P.(MD)No.3562 of 2010, for a writ of Certiorarified Mandamus, to quash theproceedings of the first appellant, made in Na.Ka.No.617/B3/02 No.8~02, dated21,8.2002 and the consequential proceedings in Na.Ka.No.8/A2/8, dated18.3.2005 and the further consequential proceedings of the second appellantmade in Mu.Mu.No.34Q/A4/07, dated 23.5.2007 and further to direct appellantNos.1 to 3 to approve the appointment of the 1st respondent, as a SecondaryGrade Teacher in time scale of pay, with all benefits and emoluments, fromthe date of appointment, ie., 15.7.2002, made in the T.D.T.A High SchoolK.Kailapuram, Gangailondan, Tuticorin District by holding G.O.Ms.No.79Education Department, dated. 14.6.2002, G.O.Ms.No.100, Education Department, dated 27.6.2003 and G.O.Ms.No.130, Education Department, dated 27.9.2004 asvoid and illegal.

3. The impugned orders, before us, are assailed on two grounds, viz., (1) There are surplus teachers working in other schools, run by thesame management and until surplus/excess teachers are deployed in thevacancy, no fresh appointments can be made and any such appointment made, cannot be approved, and (2) As per the Government Order issued by theGovernment, vacancies of Secondary Grade Teacher arose on 1.6.2002 shall befilled up only by graduate teachers, after considering the line ofjudgements, viz, 2002 Writ L.R. 173 (Secretary & Correspondent, UswathunHasana Oriental (Arabic) Girls Higher Secondary School v. The State of TamilNadu); W.A.No. 249 of 2002 etc. Batch (State of Tamil Nadu v. PallivasalPrimary School, Mudukulathur and others) dated 2.4.2004; 2004 Writ L.R. 248(Viveka Poorana Aided Elementary School v. The Director of ElementaryEducation & another) W.P(MD).No.1882/2008, dated 10.3.2008 (RoselinGnanaseeli Princy v. District Elementary Educational Officer, TirunelveliDistrict and 2 others); W.P(MD).No.2884/2009, dated 10.9.2009 (K. Ponshanthiv. District Elementary Educational Officer, Tirunelveli and another); andW.P(MD).No.13330/2011 (S.lmmanvel Gnanaraj v. Additional Assistant ElementaryEducational Officer, Tirunelveli District and 2 others), a learned singleJudge in W.P.(MD)No.3562 of 2010, dated 24.01.2014, considering the facts andcircumstances of the case, held as follows:

6. In all these judgments, the learned brother Judges of this Courtwere pleased to reject such ground and pleased to observe that there is nojustification to deny the approval on the ground of surplus teachers when thepetitioners are fully qualified for being appointed in the sanctionedvacancies and the schools are eligible to retain the said post and theavailability of excess teachers cannot be a ground to deny such approval. Inview of such legal position, the first ground on which the approval isrejected, cannot be allowed to stand.

7. Regarding the second ground, the G.O referred to in the impugnedorder is G.O.Ms.No.79, dated 14.6.2002 and that the Government is proposed tocreate middle grade graduate teachers initially in the Government schoolhaving teacher cum pupil ratio at 1:40 for teaching 6 to 8 classes. TheGovernment having found the standard of secondary grade teachers is too lowto teach 6 to 8 classes, made necessary amendment in the Rules by creatingthe post of middle grade teachers under various category under G.O.Ms.No.125,School Education, dated 12.11.2003. As per which, junior grade teacher postis created in all levels. It may be true that G.O.Ms.No.79 dated 14.6.2002provides for filling up of vacancies as on 1.6.2002 as middle grade graduateteacher. But the G.O cannot be given retrospective effect and theappointments made much before the creation of the post of middle gradegraduate teachers, cannot be denied the approval with effect from the date ofappointment, as done in the present case. As the proposal created only byGovernment Order dated 12.11.2003, the appointment duly made ought to havebeen approved. As already stated, the petitioner is fully qualified to beappointed as Secondary Grade Teacher and he was appointed as Secondary GradeTeacher on 15.7.2002, much before the creation of the post and much beforeamendment being introduced in the relevant rules. As such, the EducationalAuthorities ought to have approved his appointment from the date ofappointment with all monetary benefits.

8. In the result, the writ petition is allowed as prayed for and therespondent Nos.1 to 3 are directed to regularise the appointment of thepetitioner as Secondary Grade Teacher from 15.07.2002 with all attendant andmonetary benefits, within a period of eight weeks from the date of receipt ofcopy of this order.

4. Being aggrieved by the same, appellant has filed the instant writ appeal on various grounds.

Heard the learned counsel appearing for the parties and perused thematerials available on record.
