Sah, learned D.A.G. assisted by
Mrs. Mamta Joshi, learned Brief Holder for the State.
Admittedly, as per the documents, which
have been brought before this Court, the Special
Sessions Trial No. 53 of 2019, “State Vs. Rahil”, is
already pending consideration, after framing of
charge.
At the stage, when the statement of
witnesses have already been recorded, without giving
a challenge to a charge, by filing a Revision, the C-
482 Application would not be maintainable now by
putting a challenge to the Charge Sheet, which
ultimately has now merged with the order of framing
of charge by the Trail Court.
Hence, C-482 application is dismissed with
a liberty left open for applicant to file a Criminal
Revision against the order of framing of charge and
redress his grievances as submitted in the C-482
application.
**(Sharad Kumar Sharma, J.)**
23.12.2022
PN/-|
