This case was remanded back for decision after the reviewpetition filed by the respondents was allowed. Before the review petitionwas allowed the appellant (non-applicant) had been proceeded ex parte byorder dated 27.8.2007 since he had not been served by normal mode and didnot appear in Court even after publication in newspaper. After the case wasremanded back various attempts were made for serving the appellant againbut the same have been unsuccessful. None has appeared for therespondents also.

In the circumstances this appeal is dismissed for non-prosecution.
