In

WPSB No.174 of 2012

Hon’ble V.K. Bist, J.Hon’ble U.C. Dhyani, J.

Mr. Anurag Bisaria, Advocate for the petitioner.

Mr. Paresh Tripathi, Advocate for respondent nos.1 to 3.

Ms. Sangeeta Bhardwaj, Brief Holder for the State of Uttarakhand/respondent nos.6.

Heard.

Short counter affidavit filed on behalf of respondent no.2 and 3 is accepted on record.

Learned counsel for the petitioner submits that the writ petition has rendered infructuous and same may be dismissed as infructuous but liberty be given to the petitioner to file fresh petition against the notification which was issued during the pendency of the writ.

In our view, there is no need to grant such liberty as it is always open for the parties to challenge such notification by way of filing writ petition.

In view of the above, the writ petition is dismissed as infructuous.

Misc. application stands disposed of.
