WPSS No. 576 of 2014

U.C. Dhyani, J.

Mr. Ajay Veer Pundir, Advocate for the petitioner.

Mr. Anil Dabral, Standing Counsel for the State of Uttarakhand / respondent nos. 1 to 3.

Ms. Bina Pande, Standing Counsel for the State of U.P. / respondent nos. 4 to 6.

By means of present writ petition, the petitioner seeks writ in the nature of mandamus commanding / directing the respondents to release the pending arrears of leave encashment of the deceased son of the petitioner as awarded in order dated 22.08.1994.

After arguing the writ petition at some length, learned counsel for the petitioner confined his prayer only to the extent that the representation of the petitioner may kindly be directed to be decided by respondent no. 5, at an early date.

The prayer made by learned counsel for the petitioner is worth accepting.

Learned counsel for the respondents have no objection to such an innocuous prayer.

Writ petition is disposed of by directing respondent no. 5 to decide the representation, to be filed by the petitioner enclosing all the relevant documents therewith, by a reasoned and speaking order, in accordance with law, within a period of eight weeks of presentation of certified copy of this Order along with a copy of such representation.

Needless to say that the decision so taken shall be communicated to the petitioner.
