WPMS No.3896 of 2019 Hon’ble Sudhanshu Dhulia, J.

Mr. Akram Parvez, Advocate for the

petitioner.

Mr. Bhupender Bisht, Advocate for the respondents.

The petitioner had done some works contract for the respondents. Thereafter there arose a dispute between the two and the matter has reached to the Arbitrator and presently the Arbitrator is ceased with the matter.

The grievance of the petitioner is that meanwhile the same contract has been given to another person and money has also been disbursed in his favour, though a part of which was liable to be given to the petitioner.

The prayer of the petitioner before this Court is only for expeditious disposal of the arbitration case.

Since the learned Arbitrator is already ceased with the matter and the Arbitration and Conciliation Act, 1996 prescribes a time limit for the disposal of the matter, no interference is being called for by this Court in the matter.

In case the petitioner is aggrieved in any manner, he can either move before the learned Arbitrator or the principal civil court, but writ petition is not a remedy.

Consequently, the writ petition fails and it is hereby dismissed in limine.
