C482 No. 1481 of 2013

Hon’ble V.K.Bist, J.

Mr. Lalit Tiwari, Advocate for the petitioner.

Mr. Hari Om Bhakuni, Brief Holder, for the State.

Heard.

By means of this petition moved under section 482 of Code of Criminal Procedure (for short Cr.P.C.), the petitioner has sought quashing of the order dated 04.12.2013 and 23.12.2013 passed by Civil Judge (J.D) 1st/ Judicial Magistrate Dehradun and District Judge Dehradun in Case No. 948 of 2013 and Criminal Revision No. 361 of 2013 respectively by which both the courts below have dismissed the application filed by applicant under Section 311 of Cr.P.C.

I have heard the learned counsel for the parties and also perused the application filed by the applicant under Section 311 of Cr.P.C as well as order passed by the Magistrate and the Revisional Court. The question mentioned in the application could have been asked at the time when complainant was examined. The matter is pending since 2001. I do not find any illegality in the orders. The petition under section 482 of Cr.P.C is dismissed.
