HIGH COURT OF UTTARANCHAL AT NAINITAL

Civil Revision No. 334 of 2001(Old No. 180 of 1997

Satish Chandra Chabra,

S/o Sri Ram Chandra Chabra,

R/o 64/1 Littan Road, Dehradun. … Revisionist

Vs

Sri Chandra Bhan, S/o Late Desh Raj, And five others. …. Respondents Hon’ble P.C.Verma, J.

This Revision has been field against the order dated 07.04.1997 passed by III Additional Civil Judge, Dehradun in Original Suit No. 635 of 1988, by which the learned court below has dismissed the application for amendment filed by the revisionist/defendant No.2 impleading the legal heirs of late hairs Ram Sukhiya.

Heard Sri Ranjeet Saxena, learned counsel for the revisionist.

I have perused the order impugned passed by the Addl. District Judge. The revision is barred in view of amended provisions of 115 of the Code of Civil Procedure. In my opinion the revision has no force and is liable to be dismissed.

Accordingly, the revision is dismissed. No order as to costs.

(P.C. Verma, J.)
