Hon. Prafulla C. Pant, J.

Mr. Ramji Srivastava, Advocate, present for the petitioner.

Mr. M.A. Khan, Brief Holder, present for State.

By means of this writ petition, moved under Article 226 of the Constitution of India, the petitioner has sought quashing of the first information report dated 15.12.2010, lodged by respondent No. 3, which is registered as FIR / Crime No. 498 of 2010, relating to offences punishable under Section 325, 504, 506, 302, 307 / 34 of I.P.C., at police station Kotwali, District Dehradun.

Heard.

Therefore, without expressing any opinion as to the merits of the case, this writ petition is dismissed summarily with the observation that the petitioner may move the application after his arrest before appropriate court / Board, relating to the plea that he is a juvenile.

(St[ay Application No. 11032 of 2010 also stands dismissed).]
