BA1 No. 1539 of 2014

Hon’ble U.C.Dhyani, J.

Mr. D.N.Sharma, Advocate, present for

the applicant.

Mr. H.O.Bhakuni, AGA, assisted by

Mr. S.S.Adhikari, Brief Holder, present for the State.

Applicant, who is in jail in connection with FIR No. 437 of 2014, relating to offence punishable under Sections 379 and 411 of IPC, P.S. Haldwani District Nainital, has sought his release on bail.

An FIR was lodged against unknown

thief on 11.08.2014 alleging therein that his motorcycle was stolen away by someone on 04.08.2014. The motorcycle was allegedly recovered from the possession of the applicant on 30.09.2014. Learned counsel for the applicant says that the applicant is not a previous convict and is ready to furnish reliable sureties to the Court, if he is enlarged on bail.

Considering the facts of the case coupled with attenuating circumstances, a case of bail is made out in favour of the applicant.

Let the applicant Pappu Kumar be

enlarged on bail in connection with FIR No. 437 of 2014, relating to offence punishable under Sections 379 and 411 of IPC, P.S. Haldwani District Nainital, on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the Court concerned.
