Uttarakhand High Court

CIVIL APPEAL None on 14 August 1963

WPSS No.377/09

Hon’ble Rajiv Sharma, J.

Mr. Prabhat Bohara, Advocate holding brief of Mr. P.S. Bohara, Advocate for the petitioner.

Mr. N.P. Sah, S.C. for the State.

Ms. Beena Pandey, Addl. CSC for the State of U.P.

Petitioner’s father was appointed on 14.8.1963 as an Assistant Teacher in District Education Board, Pithoragarh. He was absorbed in the government job on 30.8.1970. However, the services rendered by him w.e.f. 14.8.63 till 1970 have not been considered as the qualifying service for granting the pensionary benefits.

Attention of the Court has been drawn to the G.O. dated 2.8.2006 whereby a decision has been taken to consider the qualifying service of the teachers who have worked in non-governmental schools also, however subject to certain conditions.

Petitioner’s father has already complied with the terms and conditions of this order. Accordingly, the petition is disposed of with the direction to the respondents to consider the case of father of petitioner for counting the qualifying service w.e.f. 14.8.1963 till 1970 on the basis of Government Order dated 2.8.2006, within ten weeks from today.

All pending applications also stand disposed of.
