In Re: An application under Section 482 of the Code of CriminalProcedure, 1973.

AND

In the matter of:-

Smt. Madhuri Mukherjee & ors. … petitioners Mr. Bidyut Roy, Ms. Manisha Sharma …for the State The present revisional application was preferred against theFirst Information Report registered in connection withShyampukur Police Station Case No.11 of 2012 dated 12.1.2012.The petitioner approached this Court at a stage when theinvestigation of the case was pending.

Records of the revisional application reflects that therevisional application appeared on 14.06.2012 and 07.08.2012.On both the occasions, adjournment was sought for and till datethe revisional application has not been admitted.

Having regard to the fact that the petitioners approached thisCourt at the stage of the investigation proceedings continuing, Ido not find any of the point so canvassed in the revisionalapplication calls for interference at this stage. If the petitionersare aggrieved by the report submitted in final form by theinvestigating agency and the subsequent charge so framed by the jurisdictional Magistrate, the petitioners will be at liberty toagitate the point canvassed in the revisional application at thatstage. For the present moment no interference is called for.

With the aforesaid observations C.R.R.1318 of 2012 isdismissed.

Pending application, if any, is consequently disposed of.

All parties shall act in terms of copy of this order downloadedfrom the official website of this Court.
