O R D E R:

It is alleged that the petitioner and two othersengaged the Car on hire and that on the way when thedriver went for taking tea, A.1 to A.3 started the vehiclewith an intent to commit theft of the Car and that when thedriver shouted, A.1 to A.3 left the Car and ran awaythinking that the public may come. It is contended that thepetitioner did MBA in Foreign countries. It has no bearingin deciding the fact in issue. It is further contended thattwo different numbers are given for the Car in FIR and inthe charge sheet and that both the numbers relate to threewheelers and not to a Car which is a four wheeler. Correct number of vehicle which is alleged to have beenattempted to be stolen is a matter for evidence. Simplybecause a wrong number is given, it may not be a groundto throw away the case at its threshold.

Hence, the Criminal Petition is dismissed.

Dt. 30[th] December, 2011.
