Smt. Radha Rani Ghosh -Vs.- Sri Gouri Sankar Bhattacharya & Ors.
Mr. Tapash Kumar Bhattacharya
…for the petitioner.
Mr. Soumik Ganguly, Mr. Diptendu Narayan Banerjee, Mr. Samrat Paul …for the opposite parties.
1. The instant revisional application was filed challenging the impugned order dated 12.10.1985 passed by the learned Additional District Judge, 1[st]Court, Burdwan in connection with Misc. Appeal No. 117/1983.
2. By passing the impugned judgment and order the 1[st] Appellate Court reversed the judgment and order dated 02.07.1983 passed by the learned Munsif, 2[nd] Court, Katwa, District – Burdwan in connection with Misc. Case No. 44/1977.
3. This Revisional Case was registered in the year 1986 and as the petitioner did not take any step the present revisional application was dismissed for default by passing an order of a Division Bench of this Court on 27.09.2012. Thereafter, an application was taken out at the behest of the petitioner with a prayer for restoration of the said revisional application in its original file and number.
4. It appears that the said order of dismissal dated 27.09.2012 was passed by the then Hon’ble Division Bench of this Court. So, this Court being the Single Bench cannot hear the application filed by the petitioner with a prayer for restoration the civil revisional application to its original file and number after setting aside the order of dismissal passed by the Division Bench of this Court.
5. Let the matter go out of list. Liberty is hereby given to the parties to mention the matter before the appropriate bench.
