ORDER:

·

This writ petition is filed by the petitioner seeking a Writof Mandamus to declare the action of the 1[st] respondent innot arresting the 2[nd]respondent and completinginvestigation into Crime No.361 of 2009, as illegal andarbitrary.

·

22. According to the petitioner, on 19.10.2009 she fileda private complaint against the 2[nd] respondent herein andothers before the Additional Junior Civil Judge, West &South at L.B. Nagar, for the offences under Sections 420,468 and 506 IPC and Sections 4 and 5 of the A.P.LandGrabbing (Prohibition)Act, 1982, who forwarded the same tothe 1[st] respondent for investigation and final report. Afterreceiving the complaint, the 1[st] respondent registered thesame as a case in Crime No.361 of 2009 against theaccused therein. Though the 1[st] respondent registered thecrime, he has not started investigation into it so far. Beingaggrieved by the same, she approached this Court and filedthe present writ petition.

·

3. Heard both the learned counsel.

·

44. When once a crime is registered, the police are dutybound to investigate into it and submit a final report before acompetent criminal court. As seen from the record, it is clearthat the petitioner filed a private complaint before theAdditional Junior Civil Judge, West & South at L.B. Nagar, on19.10.2009. It is true that it would take some more time forthe 1[st] respondent to complete the entire investigation, but atthe same time he shall see that the investigation is completed, at the earliest. In the light of the same and as it isthe grievance of the petitioner that there is no progress in theinvestigation of the crime, this court is of the view that thiswrit petition can be disposed of with a direction to the 1[st]respondent to complete the investigation.

·

55. Accordingly, this writ petition is disposed of directingthe 1[st] respondent to complete the investigation and file afinal report, as provided for under Section 173 Cr.P.C. beforea competent criminal court, preferably, within a period of four(4) months from the date of receipt of a copy of this order. There shall be no order as to costs.
