ORDER:
This Criminal Petition under Section 438 of Cr.P.C. [is]lrled by the petitionerf A3, seeking anticipatory bail inCrime No.292 of 2Ol7 on the file of the S.II.O., BhongirTown Police Station, Rachakonda District, registered for [the]offences punishable under Sections 448, 427, 384 and120-B IPC.
2. Heard learned counsel for the petitioirer as well asthe learnecl Additional Public Prosecutor aLppearing forrespondent-.State.
3. The case of the prosecution is that on 21.O7.2077the complainant and his sons filed a complaint against theaccused alleging that their father purchasecl property inSy.No.125, admeasuring 484 sq. yards situated at KisanNagar, Bho:egir mandal, Nalgonda District, atrout 60 yearsago from NLAIi Janab Mir Kalandar Hussain Saheb andconstructed compound wall around it and since then hewas in possession of the same. After demise ol their father,many unsc,cial elements approached their mother andthreatened to vacate the house or to sell it. When theirmother refused, they broke open the part of t1-re compoundwall. It is further alleged that the petitioner and otheraccused ,:laimingS Nayeem associates abused andterrorized their mother to death. The accusec also created false documents on the complainant's land. Hence, thecomplaint.complaint.
4. Learned counsel for the petitioner submits that the petitioner is an innocent person and no way concernedwith the offences and he was lalsely implicated in this caseat the behest of his enemies. He further submits that wifeof A1 and one Varkala Pushpamma acquired the saidproperty from de facto complainant and the same wasmutated in the municipality and after verification of therecord, A3 purchased the property under a registered saledeed by paying valuable consideration and after obtainingpermission from the municipality, he constructed a house.He further submits that the de facto complainant hatched aplan to grab the property by using the name of GangsterNayeem. He further submits that the petitioner is sufferingfrom Kidney problem and he has to undergo dialysisfrequently. He further submits that the major part of theinvestigation is completed and the petitioner is having hxedabode and ready to abide by the conditions imposed by thisCourt. He further submits that the petitioner is a lawabiding citizen and ready to furnish sufficient sureties andhence, he prays to grant anticipatory bail to the petitioner.
5. On the other hand, the learned Additional PublicProsecutor representing the State vehemently opposed thebail application. "

6. Looking into the nature of allegations [made]against the petitioner and also keeping in view the [facts]and circurrrstances of the case, I am inclined to [grant]anticipatorl' bail to the petitioner by imposing someconditions.
7. Accordingly, the Criminal Petition is aliowed andthe petitioneri A3 is directed to be released c n bail in theevent of his arrest in connection with Crime No.292 of 2017of Bhongir Town Police Station, RachakondeL District, onhis executinga personal bond for Rs.25,Ot)O/- (Rupeestwenty five thousand only) with two local sureties for a likesum each to the satisfaction of the said Station HouseOfficer and subject to the condition that the petitioner/A3would cooperate with the investigation Agency and wouldreport before the above Police Station, on each alternateday between 10-00 a.m. and 12.00 noon ti1l c'ompletion ofinvestigation. It is made clear that no furthe,r applicationfor relaxation of condition shall be ent ertained tilicompletion of investigation. Miscellaneous petitions, if anypending, sh,a1l stand closed.
