At their request, the Writ Appeal itself is taken up for disposal at the admission stage. The appellant/writ petitioner filed this appeal seeking to assail the order dated29.11.2005 in W.P.M.P.No.31578 of 2005 in W.P.No.24567 of 2005, wherein thelearned Single Judge ordered Notice Before Admission. The main grievance of theappellant is that even though he has satisfied with the conditions and the domicilerequired, his case has not been considered and his application was sought to berefused. The learned Single Judge ordered Notice Before Admission and posted thematter after two weeks as per the order dated 29.11.2005.

Having heard the counsel on either side and on perusal of the materialavailable on record, it is seen that in view of the fact that the appeal is filed only against the order with regard to the notice at the stage of admission, necessarily it calls for an opportunity to either side, as it is only an interlocutory order. Hence, we do not find any merits in the above appeal.

The Writ Appeal is accordingly dismissed. No costs.

However, the respondents shall file counter in the Writ Petition within one week from today. Office to post the matter accordingly.
