THE HON'BLE MR JUSTICE B.PRAKASH RAO

And

THE HON'BLE MR JUSTICE M.VENKATESWARA REDDY

WRIT PETITION NO.23409 of 2006

ORDER:(Per the Hon’ble Mr Justice B.Prakash Rao)

Heard Ms.M.Lakshmi Prasad, learned counsel for the petitionerand the learned Government Pleader for Services II for therespondents. At their request, the Writ Petition itself is taken up fordisposal.

The petitioner herein, who was the contesting respondent beforethe Andhra Pradesh Administrative Tribunal, Hyderabad (‘the Tribunal’for brevity), filed this Writ Petition, inter alia, seeking to assail the orderdated 29.08.2006 in O.A.No.3583 of 2006, wherein in an applicationfiled by the third respondent, a direction was given to consider anddispose of the appeal filed by him. Hence, the Writ Petition.

Though several contentions sought to be urged on merits inrespect of the seniority reserving the third respondent herein, sincesubstantive appeal is still pending consideration before the secondrespondent, as rightly directed by the Tribunal, it would suffice in the interest of justice to direct disposal of the said appeal rather than going into merits. Even otherwise, having regard to the fact that thealternative appeal remedy has already been availed by the contestingrespondent, neither the Tribunal nor this Court could venture to go intothe merits.

The Writ Petition is disposed of directing the second respondentto dispose of the appeal in accordance with law within a period of four{4} weeks from the date of receipt of a copy of this order. No costs.
