This Writ petition is filedfor issuance of a Wit of Mandamusdeclaring the action of the 2narespondent in passing the Order,dt.16.O7.2O21 in compliance of the order of this Court, dL.Ll.06.2O2l tnWP.No. l3 l5g of 2021, as being illegal and arbitrarJz.
2. Heard learned counsel for the petitioner, Sn S.Surender Reddy,learned Standing Counsel, appearing for respondents No.l & 2, a-rrd withtheir consent the Writ petitlon is taken up for hearing and disposal atadmission stage.
3. In view of the facts ard circumstances of the case, without delvinginto the merits of the matter, since the petitioner has a remedy of appealunder Section 252 of the Telangana Municipalities Act, 20lg (for short,the Act') against the order impugned; that admitredly, the petitioner didnot avail the said remedy; and that as it is not shown to this Court of thesaid remedy of appea-r is inefficacious, ttris court is of the view that thepetitioner should be relegated to avail the remedy of appeal under Section 252 of the Act 4Granting liberty to the petitioner as aforesaid, the Writ petition isdisposed of. No order as to costs Consequently, miscellaneous petitions, if any, pending in this writ 5petltion shall stand closed To
