WRIT PETITION No.26667 of 2006

ORDER:

The petitioners filed an appeal before the Revenue DivisionalOfficer under subsection (5) of Section 5 of the Andhra Pradesh Rights inLand and Pattadar Pass Books Act, 1971. On 12.12.2006, they filed anapplication styled as “MEMO OF WITHDRAWAL”. In the saidapplication, they prayed the first respondent (Revenue Divisional Officer)to permit them to withdraw the appeal. It appears, the first respondentdeclined to do so. Therefore, they filed the Writ Petition seeking amandamus.

The matter was initially heard at the preliminary stage in the postlunch session. At the request of the learned Assistant GovernmentPleader for Revenue (General-T), it was passed over. After gettinginstructions from the first respondent, the learned Assistant GovernmentPleader submits that the matter stands posted to tomorrow i.e.,23.12.2006, and the first respondent will close the case as withdrawn.

The same is recorded, and the Writ Petition is accordingly disposedof. No costs.
