JUDGMENT(Per Sri B.Prakash Rao, J)

Heard both sides and at their request, the main appeal itself is taken upfor disposal.

Admittedly, the order challenged in this appeal is only ex-parte one.

Though the learned Government Pleader was heard at the time ofpassing of the order, the fact remains that the counter affidavit is yet to be filed. In view of the same, we do not find any merits at this juncture to interdict thesame.

Accordingly, the writ appeal is dismissed leaving open to the appellantsto file comprehensive counter affidavit for vacating the orders passed by thelearned single Judge whereupon on merits, the matter can be reconsideredafresh. No costs.
