ORDER:
1 On the basis of the report given by the second respondent herein,Munugodu police, Nalgonda District registered as a case in Cr.No.56 of2010 against the petitioner for the offence punishable under section 366of IPC.
2 However, during the pendency of the said proceedings, itappears, there was a settlement between the parties and in view of thesaid settlement, the second respondent agreed to withdraw the saidcomplaint. In the light of the said compromise entered into between theparties, the petitioner filed the present petition under section 482 ofCr.P.C. requesting this court to quash the said proceedings.
3 Today parties are present. When questioned the secondrespondent by name Pollogoni Lingesh stated that the matter is settledout of court and that he is not interested in getting the matter prosecuted. He further submitted that he has no objection if the said proceedingsagainst the petitioner are quashed.
4 As the complainant himself appeared before this court and statedthat he is not interested in getting the matter prosecuted, this court is ofthe opinion that the said proceedings pending against the petitioner canbe quashed. Accordingly, this petition is allowed and the proceedings inCr.No.56 of 2010 on the file of P.S. Monugodu, Nalgonda District,pending against the petitioner are hereby quashed.
