ORDER:
“When the matter has come up for hearing, the learned counselfor the petitioner submitted that the petitioner brought an amount of Rs.1,00,000/- cash. The said amount is paid to 2[nd] respondent viZ., Mr.B.Butchi Reddy, in open court and 2[nd] respondent also acknowledgesthe same by filing a stamped receipt. He contended that he parted awaythe amount from out of his pension benefits on 10-06-1998 and sincelast 9 years he has lost the interest on the said amount.
Under the above circumstances, the learned counsel submittedthat interest at 18% may be directed to be paid by the petitioner. I seesome force in the contention raised by the counsel for the 2[nd]
respondent and as per the calculation it comes to Rs. 1,62,000/-. Further, the petitioner has already fixed an affidavit on 10-08-2007 byundertaking to pay the interest as fixed by this Court. So, taking note ofthe said undertaking and of the submissions made on behalf of the 2[nd]respondent, I feel it would suffice if the matter is posted to 12-09-2007 forpayment of interest of Rs. 1,62,000/-. Post on 12-09-2007.”
