ORDER:
The present Criminal Revision Case is filed [seeking ][to ][allow]the Revision Case by setting aside [the ][docket ][order ][dated]13.07.2015 passed in Crl.M.P.No.5229 of [2073 ][in ][C.C.No.2931 ][of]2OOS by the Court of the [I Additional ][Judicial ][Magistrate ][of First]Class, Huzurabad.
2. Heard learned Assistant Public Prosecutor [appearing ][for ][the]respondent - State. Perused [the ][record.]
3. Brief facts of the case are that [based on ][the ][complaint ][given]by l,W1 that the accused on [the ground ][that ][he ][will ][provide patta]lands to LW I ancl also [provide ][jobs ][to ][his ][wife ][and ][son ][has]collected rnoney fro rn him and [cheated ]him, [a ][case ][was ][registered]in Crime No.l34 ol. ['2OO4 ]belore the [Hr-rzurabad ][Police ][Station, for]tlre offence punistrable under Section 42O of [IPC. ][After]case was taken on llle [as ]C.C.No.293l [of ][2OO8]investigation, said on the file of the .]ucliciat Magistrate [of ]First [Class, ][Huzurabad, for]ttre offences [punishable ]under [Sections 42O, ][468, ][+71 ][and ][472 ][of]IPC. During the pendency of the said C.C., tJle [accused ][filed ][a]petition uncler Sectior:. 482 of Cr.P.C before this Court [vide]
Cr1.P.No.54O8 of 2O1O to [quash ][C.C.No.2931 ][of ][2O0B ][and ][this]Court, vide its order [dated ][74.O6.2OL3, ][had ][pennitted ][the]petitioner to withdraw the same with liberty [to ][file ][an ][application]under Section 239 of Cr.P.C or [an ][application ][for ][compounding]the offences, which shall [be considered ][in ][accordance ][with ][law']Thereafter, the accused filed [Cr1.M.P.No.5229 ][of ][2O13 ][in]C.C.No.2931 ol 2OO8 on [the ][file ][of ][ttre ][Court ][of the ][I ][Additional]Judicial Magistrate ol First [Class, ][Huzurabad, ][to ][discharge hirn]from the above said [oflences ][and ][the ][Magistrate, vide ][its ][clocket]orcler dated lg.O7.2Ol5, [had ][dismissed tJle ][petition ][stating that]ttre petition is not rnaintainable. [Aggrieved ][by ][the ][same, ][the]accused has preferred [the present ][Criminal ][Revision ][Case']
4. Learnecl Assistant Public [Prosecutor ][aplxaring ][for]respronde nt-State would [submit ][that ][the ][learned ][trial court ][after]appreciating the material [facts ][before ][it ][has ][passed ][the ][orcler']Thcrcfore, interlerence of this [Court at ][this ][stage ][is ][unwarranted']Hence seeks to clistniss [the ][present ][criminal ][revision ][case']
5. Recording the subrnissions made [by the ][learned Assistant]public Prosecutor and upon perusing the entire rnaterial availableon recortl, I clo not find any [reason ][to ][interfere ][with ][tlre ][well]
reasoned order passed by the Court below. Therefore, this Court isnot inclined to entertain the present Crirninal Revision Case.not inclined to entertain the present Crirninal Revision Case.
6. In the light of the discussion made herein before, thisCriminal Revision Case is dismissed.
Miscellaneous Petitions, pending if any, shall stand closed.
