JUDGMENT :-
The matter has been coming for hearing from 26.11.2012 and norepresentation and it was posted for dismissal to 03.12.2012. On03.12.2012, there was no representation and posted to 07.12.2012. On07.12.2012, it is represented that the first respondent died and theappellant is to verify and report and the matter is posted to 13.12.2012. Thereafter, it was called on 17.12.2012 and the matter is again called today.
The appeal was in fact filed by Sri B.Purushotham Reddy,Advocate. He made a representation that he had no bundle and he had noinstructions and wanted the court to issue notice to the appellant.Evidently, he filed his Vakalat and holds the Vakalat. It is not the duty ofthe court to issue notice to the appellant. Evidently, his representationbefore the court clearly shows that he has no instructions from his client. Therefore, his demand for issuing notice to the appellant is unwarranted.
Consequently, the Appeal is dismissed for non-prosecution. No costs. Miscellaneous Petitions, if any, pending in this Appeal shallstand closed.
