Hearrl Sri Mummaneni [Srinivasa ][Rao, ][learned]counsel appearing [on ][behalf ][of ][the ][petitioner, ][learned]Government Pleader for Social [Welfare, appearing ][on]behalf of respondent [Nos.l ][to ][3 ][and Sri ][S. Madan Mohan]Rao, learned counset appearing [on behalf ][of ][respondent]No.4.

2. The [petitioner ]approached [the ][Court ][seeking]prayer as follows:

"...to i:;sue a Writ, Order or direction more [particr"rlarly]one in the nature of [Mandamus, ][declaring ][the ][action]the impugned [proceedings ]vide [case ][file ][No.]Al3/Btaqlz}lg dated Nil, on the file [of ][the ][Aqency]Divislonal Officer - Sub-Collector [(Tribal ][Welfare]Department), Bhadrachalam, Bhadradri [Kothagudem]District, served on the [petitioner ]on [03.01.2020 ][in]connection with the house No.g-1-29 to [an extent of]153 Sq.Yards of the land in Sy.No.121l13P [of]Bhadrachalam Village and Mandal, [Bhadradri]Kothgudem District [(The ]land in Sy [No.l.21l13P ][to ][an]exten[ of Ac.196-80 cents, Government [Land](Gramakantam) is without power or authority,contrerry to the provisions of Land [Transfer]

Regulations 1959 read with Act U7O is illegal andvoid and opposed to Articles 14, 79,21 and 300-A ofConstitution of India and consequently to direct the2nd respondent not to interfere with the peacefulpossession and enjoyment of the petitioner house inquestion described as Gramakantam land, withoutfollowing due [process ]of law, and to [pass ]such otherorder or orders as this Hon'ble Court may deem fitand proper in the circumstances of the case."

Brief facts of the case are that, the [petitioner's ]land inSy.No.121l13P totaling to an extent of Acs.196.80 cents inBhadrachalam Village and Mandal, Bhadradri KothagudemDistrict, is Gramakantakam land and the same was occupiedby hundreds of people from [past ]six decades by constructinghouses and living in their respective [portions ]by entering theirnames in Gram Panchayat records by allotting the doornumbers without interference of any third [parties ]orauthorities till date. Respondent No.4 created [certain]documents and filed an application before Gram [Panchayat]seeking for change of the [petitioner's name ][and ][to ][record]respondent No.4 name in [place ]of [petitioner's name ][in ][the]said the Gram Panchyat records. [Thereafter, ][the ][Gram]Panchayat issued a notice to the [petitioner ][dated 07.10.2013]directing the [petitioner ]to file [objections ][within ][7 ][days ][to]

the [entries and ][the ][petitioner ][filed ][W'P'No'31364 ][of]change 2013 [questioning ][the ][said action ][of ][the ][Gram ][Panchayat ][and]this Court [granted ][interim orders ][of ][stay ][of ][all ][further]proceedings in [favour ][of ][the ][petitioner' ][Consequent ][to ][a]representation [filed ][by ][the ][respondent ][No'4 ][before P'O' ][ITDA']dated 25.11.2019, [respondent ][No'2 ][had ][issued ][notice ][under]the impugned [proceedings' ][Aggrieved ][by the ][same' ][the]the [present ][writ ][petition']petitioner filed

It is represented [by ][both ][the ][learned ][counsel appearing]on behalf cf [the ][petitioner and ][learned ][counsel ][appearing ][on]behalf of [respondent ][No.4 ][that the ][writ ][petition could ][be]disposed [01'directing ][the ][petitioner ][to ][submit an ][explanation]to the Form-E [notice, ][vide ][impugned ][proceedings]No.A/3/BCM/2019 [dated ]['Nil'of ][December, ][2019 ][issued ][to ][the]petitioner by respondent [No.2 ][within ][a ][reasonable ][period ][and]competent authority [i.e., ][respondent No'2 ][to ][consider ][the ][said]explanation to [be ][furnished ][by ][the ][petitioner ][within ][a]reasona ble Period.

5. Taking [into ][consideration ][the ]aforesaidsubmissions [put-forth ][by ][the ][learned ][counsel appearing]on behalf of [the ][petitioner ][and ][learned ][counsel]

appearang on behalf of respondent No.4, the writ petition is disposed of directing the petitioner to submitan explanation to the Form-E notice issued to thepetitioner by respondent No.2 vide case FileNo.A/3/BCM /201,9, dated December, 2019 within aperiod of two (2) weeks from the date of receipt of acopy of the order and upon respondent No.2 receivingthe said explanation, the respondent No.2 is directed topass appropriate orders within a period of four (4)weeks thereafiter by giving an opportunity of personalhearing to both the petitioner and respondent No.4herein and decide the subject issue in accordance tolaw, in conformity with the principles of natural [justice]and duly communicate the decision to the petitionerand respondent No.4 herein.

6. Upon the consent of learned counsel appearing onbehalf of the petitioner and learned counsel appearingon behalf of respondent No.4, the writ petition isaccordingly disposed of. However, there shall be noorder as to costs.
