The lacts in issue are that the petitioner is the owr.rer of the lnnovavehicle bearing No.TS 10 EC 6667 and rhe said vehicle w,as seized inCrime No.277 of 2020 of Bhadrachalam J'own Police Station. which wasregistered for the offences punishable under Section 8(c) read with Section20(bxii)(B) of the N.D.P.S.Act, 1985, and the said vehicle was kept in rhepolice station. During the pendency of investigation, the petitioner,claiming to be the owner of the said vehicle, filed Crl.M.P.No.409 ol 2020betbre the Special Sessions Judge for the frial ol Cases under NarcoticDrugs and Psychotropic Substances Act-cum-I-Additional Sessions Judgeat Khamrram, seeking interim custody o1'the vehicle. By an or.der, dated31.08.2020, the learned Judge re.jecred the applicatiorr. Challenuing rhesanre the present revision is llled

3. l-.earned counsel lol the petitioner submits that there is er, ervpossibility of the vehicle getting damaged, [jf ]it is 1<ept exposeci ro vagariesof nature at the premises of Police Station and hence seeks intelim custodyof the vehicle.

5. ln Surenderbhai Ambalsl [Desai ][v. ][State ][of ][Guiaratt ], [the ][Apex]Court has laid down that in [case ][of ][vehicles ][seized ][during ][investigation,]they should not be allowed to [deteriorate ][by ][being kept ][unused ][and]unattended in the [premises ][of ][the ][Police ][Stations. ][Therefore, the ][vehicles]have to be entrusted to [the interim ][custody ][of ][the ][petitioner ][subject ][to]appropriate conditions.6.
